Six figure award for negligent treatment of pancolitis.
John Coulson of the CNCI team has settled a claim arising from negligent treatment of pancolitis. It was alleged on behalf of the Claimant, a woman in her 50s, that following a surgical procedure she developed sepsis in her lower pelvis leading to multiple fistulation.
She had to live with significant and highly intrusive symptoms of bladder and bowel problems. She required multiple investigations, many under general anaesthesia. She was left the permanent ileostomy and suffered from skin excoriation. She also experienced chronic lethargy and anaemia.
Liability was denied and the Claimant was put to proof on causation.
Following the commencement of Court proceedings, the Defendants put forward a Part 36 offer in the sum of £100,000 in settlement of the claim. The offer was made without any admissions in respect of breach of duty.
After careful consideration of the medical issues and the evidence relating to the Claimant's losses, the Claimant decided to accept the Defendants Part 36 offer in full and final settlement of her claim.
